These Terms and Conditions ("Terms") govern your access to and use of the website located at https://www.jackcustomjewelry.com (the "Site"), our online ring builder tool, our text messaging program, and any related services, content, or products offered by Jack Custom Jewelry ("we," "us," or "our"). By accessing or using the Site or any of our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site or our services.

1. Acceptance of Terms

By accessing the Site, using the ring builder, scheduling an appointment, opting into our text messaging program, or making a purchase, you confirm that you are at least 18 years old (or have the consent of a parent or legal guardian) and that you agree to comply with and be legally bound by these Terms, along with our Privacy Policy. If you are using our services on behalf of a business or other entity, you represent that you have the authority to bind that entity to these Terms.

2. Use of the Site and Ring Builder

Jack Custom Jewelry provides an online ring builder tool that allows you to design, configure, and save custom jewelry concepts. You may use the ring builder for personal, non-commercial purposes only. You agree not to:

Use the Site or ring builder for any unlawful purpose or in violation of any applicable laws or regulations.
Reverse engineer, copy, modify, or create derivative works based on the ring builder, the Site, or any of its underlying code or design elements.
Use automated systems (including bots, scrapers, or crawlers) to access, collect, or interact with the Site without our prior written permission.
Interfere with, disrupt, or attempt to gain unauthorized access to the Site, our servers, or any associated systems.
Submit false, misleading, or fraudulent information when using the ring builder, scheduling appointments, or contacting us.

We reserve the right to suspend or terminate your access to the Site or any service at our sole discretion, with or without notice, if we believe you have violated these Terms.

3. Custom Orders and Quotes

The ring builder is a design and inquiry tool. Saving a configuration or submitting a design through the ring builder does not constitute an order or a binding contract. All custom jewelry orders are subject to a separate written agreement, quote, or invoice provided by Jack Custom Jewelry. Pricing displayed in the ring builder, if any, is an estimate and may change based on materials, market conditions, design complexity, and final specifications confirmed during your consultation.

A custom order is considered confirmed only when:

A formal quote or invoice has been issued by Jack Custom Jewelry,
You have approved the final design and specifications in writing, and
The required deposit (if applicable) has been received.

4. Payment, Deposits, and Refunds

For confirmed custom orders, a non-refundable deposit may be required before work begins. The deposit covers the cost of design time, materials sourcing, and labor already incurred. Because each piece is custom-made to your specifications, custom orders are non-refundable and non-returnable once production has begun, except in cases of manufacturing defects or as otherwise required by law.

Final payment is due upon completion of the piece and prior to delivery or pickup, unless otherwise agreed in writing. We accept payment methods as communicated to you at the time of order. All prices are in U.S. dollars unless otherwise stated.

5. Appointments

You may schedule consultations or appointments with Jack Custom Jewelry through the Site, by phone, or by email. We ask that you provide reasonable notice if you need to cancel or reschedule. Repeated no-shows or last-minute cancellations may result in our refusing to schedule future appointments.

6. Text Messaging Program

The following terms apply specifically to our SMS/MMS text messaging program. By opting in, you agree to the terms in this Section 6 in addition to the rest of these Terms.

6.1 Program Name

6.2 Program Description

When you opt in to receive text messages from Jack Custom Jewelry, you may receive SMS and MMS messages related to your ring design, saved configurations, appointment scheduling, order updates, and related communications from Jack Custom Jewelry. These messages are sent to help you stay connected with Jack Custom Jewelry regarding your jewelry inquiry.

6.3 Consent and Opt-In

By checking the SMS consent checkbox on the Jack Custom Jewelry ring builder and providing your phone number, you expressly consent to receive text messages from Jack Custom Jewelry at the phone number you provided. Consent is not a condition of purchase or use of the ring builder tool. You may use the ring builder without opting in to text messages.

6.4 Message Frequency

Message frequency varies depending on your interaction with Jack Custom Jewelry. Typical messages include appointment confirmations, follow-ups on saved ring designs, and responses to your inquiries. You will not receive more than 3 messages per month unless you initiate additional conversations.

6.5 Message and Data Rates

Message and data rates may apply. Please contact your wireless carrier for details about your messaging plan. Jack Custom Jewelry is not responsible for any fees charged by your carrier.

6.6 Opt-Out

You can opt out of receiving text messages at any time by replying STOP to any message you receive from Jack Custom Jewelry. After sending STOP, you will receive a one-time confirmation message, and no further messages will be sent unless you opt in again. If you experience any issues opting out, contact us using the information in Section 14.

6.7 Help

For help or questions about the text messaging program, reply HELP to any message you receive, or contact us using the information in Section 14.

6.8 Supported Carriers

Messages are supported on all major US wireless carriers including AT&T, Verizon, T-Mobile, Sprint, and others. Carriers are not liable for delayed or undelivered messages.

6.9 Program Changes

Jack Custom Jewelry reserves the right to modify or discontinue the text messaging program at any time. In the event of any changes to these terms, an updated version will be made available on this page. Continued participation in the program after changes constitutes acceptance of the revised terms.

7. Intellectual Property

All content on the Site — including but not limited to text, graphics, logos, icons, images, photographs, videos, ring builder designs and templates, software, and the overall look and feel of the Site — is the property of Jack Custom Jewelry or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, publish, display, perform, modify, create derivative works from, transmit, or in any way exploit any content from the Site without our prior written consent. The "Jack Custom Jewelry" name and logo are trademarks of Jack Custom Jewelry and may not be used without permission.

Designs you create using the ring builder remain associated with your inquiry. By submitting a design, you grant Jack Custom Jewelry a non-exclusive, royalty-free license to use, reproduce, and modify the design solely for the purpose of fulfilling your inquiry, providing you with a quote, and producing your custom piece.

8. User-Submitted Content

If you submit photos, reference images, design ideas, testimonials, or other content to Jack Custom Jewelry through the Site, email, text, or any other channel, you represent and warrant that you own or have the necessary rights to submit that content and that it does not infringe on the rights of any third party. You grant Jack Custom Jewelry a non-exclusive, perpetual, royalty-free, worldwide license to use, reproduce, display, and adapt that content in connection with our business, including for marketing and promotional purposes, unless you specifically request otherwise in writing.

9. Privacy

Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, available at https://www.jackcustomjewelry.com/copy-of-about. By using the Site or our services, you consent to the practices described in our Privacy Policy.

10. Disclaimers

THE SITE, THE RING BUILDER, AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by law, Jack Custom Jewelry disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.

We do not warrant that the Site will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Site or the servers that make it available are free of viruses or other harmful components. Colors, materials, and finishes shown in the ring builder or in product photography are representations and may vary from the final product due to differences in display settings, materials, and the nature of handcrafted jewelry.

11. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Jack Custom Jewelry, its owners, employees, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or any other intangible losses arising out of or related to your use of, or inability to use, the Site or our services, even if we have been advised of the possibility of such damages.

In no event shall our total liability to you for all claims arising out of or related to these Terms or your use of the Site exceed the greater of (a) the amount you paid to Jack Custom Jewelry in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Jack Custom Jewelry and its owners, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site or our services; (b) your violation of these Terms; (c) your violation of any rights of any third party; or (d) any content you submit to us.
